Solar Contract unfulfilled 2.5 years later after Damage to our Roof

We had purchased a New Solar system in 2022 and during installation on our New Tin roof during a New Build the Solar installers damaged our roof, several dints/creases were noticed a couple of weeks afterwards. We had brought this to the attention of the Solar company. They said they would repair the roof however the edge protection had been removed by this stage. The installer subcontracted out the installation to another company. This installer said they could repair the roof but would do it without edge protection which our Builder would not accept as it is a work safe requirement so they elected to wait until scaffolding went up for our next stage of build to do the upper storey cladding. The installer arranged for about a third of the panels to be removed to allow for the repairs to be carried out, had them stored onsite for a month then we suggested it might be best they were stored safely so they placed them in their storage. We had explained there were going to be delays in the scaffolding going up and he still did not go ahead to arrange the proper carrying out of the repairs so that the system could be completed, he elected to wait. The installer always preferred speaking over the phone rather than via email (Alarm bells should have been ringing but we believed his word). His company did not answer emails. This had all caused complication and delays in our build and we would say contributed to a breakdown of that relationship and financial stress the builder started to experience. We did not end up reaching the stage of getting scaffolding up as our Builder suspended our build. Solar panels were installed November 2022 and Lower level clad January 2023 so had the Roof been appropriately addressed the inverter could have been hung and system connected. We had to terminate our Contract with our Builder in October 2023. The installer had a full year by this time to properly address the roof repairs but elected to wait so that he didn’t have to pay for edge protection. We kept him updated on the situation and he elected to wait of r us to engage another builder. QBCC insurance process took one year so could not move on until that was complete. We engaged another builder in December 2024 and started building again in January 2025. The Installer had agreed that we would engage the original Roofing contractor to carry out the repairs and he would reimburse us which we had done. We had informed him the Scaffolding was up and the roof had been repaired early February 2025 so that the system could finally be completed but by this time the/our Panels they had in storage had ‘gone missing’. The electrician engaged to complete our build had also checked the panels out and had brought to our attention the panels were expiring 30th March 2025. We alerted the Solar company to this fact and then all of a sudden they say that they could not acquire more panels to replace the ones that had gone missing in time before they were set to expire. So now we have 2.5 year old panels left on our roof and an installer that is refusing to fulfill the contract and had ceased communication and now has had a solicitor contact us after we had asked for a resolution and reimbursement of the roof repairs. They have asked if we had claimed this with the QBCC home warranty insurance which we explained we had not as the contract for Solar was directly between Solar company and us and not the Builder. They have asserted we have possibly committed some insurance fraud and breached our contract with the Solar company and they will be seeking damages for lost STCs! After everything we have been through and the patience we had given them to address this, it is very upsetting. We have now sent through a complaint to office of Fair trade who will try to conciliate the matter however they said “Please also be aware that we cannot assist with roof repairs as that is considered a consequential loss”. I thought this would be a part of them honoring their express warranties as they had a lifetime warranty of workmanship on the installation. If anyone can provide any advice it would be greatly appreciated.
